A Waterford man was remanded in custody yesterday after he was charged with the murder of a 33-year-old man who died from stab wounds following a row in a flat in Waterford city on Tuesday night.

Mr Anthony Stone (20), from Ardmore Park, Ballybeg, Waterford, was brought before Waterford District Court yesterday morning and charged with the murder of Simon Carton at Barrack Street, Waterford, on September 7th.

Det Garda Jerry Howe gave evidence of arresting Mr Stone and charging him after caution outside Waterford Garda Station at 1.45 a.m. yesterday with Mr Carton's murder. When asked if he had anything to say, Mr Stone said: "Nothing to say," the court was told.

Insp Mick Nevin said he was seeking remand in custody and Mr Stone's solicitor, Mr Pat Newell, said he would make no application at this stage for legal aid for his client who is unemployed.

Judge William Harnett noted Mr Newell's remarks and said he could apply at a later stage for legal aid. He granted Insp Nevin's application and remanded Mr Stone in custody to appear again at Waterford District Court on September 16th.

Mr Stone spoke only to confirm his identity and say he was unemployed. He remained standing throughout the four-minute hearing at the start of the court's regular sitting.

After the hearing, Mr Stone was escorted by gardaí out through the back of the courthouse to an unmarked Garda car. He covered his head with a jumper to hide his face from waiting cameramen and photographers before being taken away.

Gardaí yesterday confirmed a second man in his 20s, also arrested on Wednesday for questioning about Mr Carton's death, has been released without charge. A file will be prepared for the Director of Public Prosecutions.

Mr Carton, from Gorey but who lived in Waterford for some years, underwent surgery at Waterford Regional Hospital but died later.
