Definite Earl jockey and trainer David Broad punished for ‘non trier’ case at Ballinrobe

Appeals against penalties imposed in the Definite Earl 'non-trier' case at Ballinrobe earlier this month are set to be heard before racing at Punchestown on Saturday.

Jockey Robbie Colgan was banned for 21 days and Definite Earl's trainer David Broad was fined €2,000 under the Turf Club's Rule 212 after a novice hurdle at Ballinrobe almost two weeks ago. The horse was also suspended from racing for 60 days.

Colgan, Broad and Definite Earl’s owner are appealing the penalties picked up after the horse finished a two and a half length runner-up to Admiral Brian.

Colgan told the original inquiry his instructions were to jump behind the leaders, get settled and pick up as much prizemoney as possible. Broad said he was satisfied with the jockey’s ride.

The inquiry is set to take place 12 days after Barry Geraghty's successful appeal against a similar ban under Rule 212 for his ride on Noble Emperor at Limerick. Tony Martin also had a €3,000 fine lifted and the JP McManus-owned horse had a 60-day suspension removed.
