A legal dispute between the ITG telecoms group and Eircell arising from the latter's refusal to allow ITG sell Eircell air time from terminals installed by ITG in some 1,500 retail outlets across the State has been resolved, the Supreme Court heard yesterday.

The court was told all matters between the sides had been resolved and no further order was required. It struck out the proceedings with no further order. In 1999, Eircell conducted a tendering process for a contract to distribute the Eircell air time. An Post won the tender but ITG was unsuccessful. Eircell had claimed ITG was fearful of competition from An Post and, through its legal action, was seeking to circumvent the result of the tendering process. ITG denied those claims and accused Eircell of abusing its alleged dominant position in the marketplace.
