A man who claimed he suffered nerve damage after his arm was struck by a pub door has been awarded €35,000 damages in the Circuit Civil Court.
Barrister Pat O’Brien told the court that on May 27th, 2009, Radoslaw Wojtkow (31) was in The Living Room pub on Cathal Brugha Street, Dublin.
Mr Wojtkow, Cork Street, Dublin, a general operative, had made his way through an emergency door which had been opened by the staff to allow people to come in and out. He claimed that the door had fallen off its hinges and he was struck on his left arm.
He attended VHI Swiftcare Clinic in Dundrum, Dublin, the next day, where no fracture was diagnosed. He later attended neurologists as the pain did not ease. A scan revealed damage to the radial nerve, which was still causing him severe pain.
He sued Murraywalsh Ltd, which trades as The Living Room, for damages.
Mr O’Brien said solicitors O’Neill Quinn had earlier obtained a judgment against the pub owners on the grounds that they had failed to enter a defence to Mr Wojtkow’s claim, which was heard yesterday only as an assessment of damages.
Mr Justice Matthew Deery awarded €35,000 damages. Representatives for the pub did not appear in court.
