A BUSINESSMAN who fraudulently sold a car received a two year suspended sentence yesterday after Dublin Circuit Criminal Court was told his wife had undertaken to pay £5,000 on his behalf to the victim.

This money is part of the woman's share in Terence Kelly's former £275,000 home at Ferndale Road, Rathmichael, Co Dublin, which was repossessed by the Irish Permanent Building Society in 1994 and resold. Another £3,000 has already been paid by Kelly's brother to the victim, a schoolmaster, Mr Conal Cannon, of Sandymount High School, Dublin.

Mr Joseph Mathews SC (with Ms Vandra Dyke), defending said that, after the house sale, the IPBS lodged £149,000 into the High Court. Six creditors and Mrs Margaret Kelly each sought a share. On March 19th last, Mr Justice Barron paid out £25,000 to Mrs Kelly.

At an earlier hearing the court was told Kelly's brother would pay £3,000 compensation. The case was adjourned to await the High Court pay out to Mrs Kelly.

In June 1994 Kelly (53) pleaded guilty to fraudulently obtaining a bank draft to the value of £8,000 and a Nissan Bluebird, valued at £1,000, on June 8th, 1992, from Mr Cannon, by falsely pretending he had the authority to sell a £9,000 Nissan Primera.
