Wicklow Heritage Trust Ltd was given leave by Miss Justice Laffoy in the High Court yesterday to challenge plans for a landfill site at Ballynagran, Kilcandra, near Rathnew, Co Wicklow.
In proceedings against Wicklow County Council, the Heristage Trust is seeking to quash a council decision made last March to submit an Environmental Impact Statement on a proposed east Wicklow landfill site at Ballynagran to the Minister for the Environment for certification.
It also wants a declaration that the proposed development is outside the powers of the council in the absence of the adoption of a waste plan under the requirements of the 1979 European Communities (Waste) Regulations.
