A PENSIONER who was arrested after failing to attend a court hearing to answer a complaint that her dog barked too much had the arrest warrant quashed by the High Court yesterday.
Ms Evelyn Breslin (77), of Hollybrook Grove, Clontarf, Dublin, who suffers from asthma, rejected allegations that she had a dog causing a nuisance by excessive barking".
Mr Thomas Fallon BL read an affidavit by Ms Breslin who said that last July a notice was placed through her letter box, alleging her dog was causing a nuisance.
The notice said that the complaint would be made at the Dublin District Court by her next door neighbour Mr Martin Fleming.
Ms Breslin said she did not believe the complaint was either a command or summons to court or placed her under any obligation to attend.
She said she was arrested last October, brought before the district judge and released on bail. She rejected allegations made against her by Mr Fleming.
The President of the High Court, Mr Justice Costello, yesterday said the warrant for Ms Breslin's arrest appeared to be completely irregular as it referred to a "summons", but none had been issued.
