Joined by Mr Tony Gregory, Mr Finian McGrath spoke out against Nice earlier today outside the Dáil.

"Ireland will lose crucial rights to a commissioner, to the veto in important areas and to effective votes on the council," said Mr McGrath.

He asked for the governement to go to its EU partners and say that they wanted a legally binding protocol ruling out Irish participation in "all EU structures". According to Mr McGrath this would mean Irish neutrality could not be defeated.

"Neutrality does not mean sitting on the fence," he said. "It means peacekeeping and assisting in humanitarianism and conflict resolution situations".

Meanwhile he dismissed claims by Nice advocates that the No campaign was based on lies. "It's a question of trust, I accept that," he said. "But we have every right to challenge and debate the issues".

Mr McGrath also accused 95 per cent of national media of being in favour of Nice and asked "how can people get an objective and balanced view".

Sinn Féin, the Greens and the Independents are already at odds with the Government over the allocation of speaking time in the Nice debates.

Four days, or 25 hours, has been given to debating the forthcoming referendum on the Treaty. The Dáil will resume for normal business on October 9th.

The Labour Party has asked that time be found for a debate on the state of the Exchequer finances. The Fine Gael leader Mr Enda Kenny is also expected to ask for an emergency debate on the issue.

It is understood that the Minister for Foreign Affairs, Mr Cowen will open the debate as the Taoiseach is still in South Africa at the World Summit. Mr Ahern will speak in the debate next week.

No date has been set for the referendum. The Minister for the Environment Mr Cullen will sign an order once a date is agreed.
