A schoolboy who fell while climbing on a steel frame in an adventure park has lost a damages claim for negligence against his school.

Dylan O’Meara (12), who has Sotos syndrome and is 6ft 4in, broke his right leg when he slipped off a climbing frame at Lullymore Heritage and Discovery Park at Rathangan, Co Kildare.

He told the Circuit Civil Court yesterday that in May 2006, when he was seven, he and 19 other classmates had joined a one-day school excursion of about 60 pupils to Lullymore.

While he was climbing down from the play frame, his foot had slipped on a rung of a ladder and he fell heavily.

Dylan, Clondalkin, Dublin, who sued through his mother Norma O’Meara, told Imogen McGrath, counsel for St Bernadette’s junior national school in Clondalkin, that he had fully recovered.

Ms McGrath successfully applied for a dismissal on the grounds that no case of negligence had been proved against the school.
