THE HIGH Court has fixed November 4th for the hearing of a dispute between solicitor Ivor Fitzpatrick and property developer Paddy McKillen about the conduct of the affairs of a large property development holding company.

The action was due for hearing earlier this month but was adjourned a number of times to facilitate talks between the sides. However, the court was told last week that those talks had been unsuccessful.

Mr Justice John MacMenamin set November 4th for the hearing, which is expected to last a month.

The case relates to the conduct of the affairs of a company called Canton Caseys Ltd (CCL), St Stephen’s Green, Dublin.

Mr Fitzpatrick and Mr McKillen are directors and Mr Fitzpatrick had claimed that they would have equal rights within the company.

However, he said he became concerned from about 2002 about the behaviour of Mr McKillen and his company, Fountain Properties Ltd, regarding CCL affairs.
