The Parades Commission will hold an emergency meeting this morning to decide if it should restrict the number of Orangemen taking part in a march to commemorate 3,000 days on Drumcree Hill.

The meeting follows a High Court hearing yesterday evening at which the commission's decision to allow the march to proceed without imposing any restrictions was challenged by Garvaghy Road resident Joe Duffy.

Mr Justice Weatherup said the commission had been informed that no general call- out had been made to Orangemen to take part in the march and that only officers of other lodges had been invited.

But that was contradicted by Portadown District Lodge's website, which called for support from brethren across the province.

"It seems to me that the Parades Commission proceeded on the basis of the assurance there was no general call-out but that is incorrect in view of the website," the judge said.

"The commission has been given an ill-founded assurance and accordingly that is a relevant consideration which requires to be taken into account in relation to their decision to issue no determination."

The judge said there seemed to be grounds for quashing the commission's decision not to make a determination but instead he remitted the matter back to the commission for further consideration.

A commission spokesman said: "We welcome the fact that the commission's decision-making process has been upheld and validated. The court has raised an issue on the numbers of participants and asked the commission to clarify the numbers. We will be meeting in the morning to look at the issue and look forward to a peaceful and dignified event."

Breandán MacCionnaith, spokesman for the Garvaghy Road Residents Coalition, said: "The court has vindicated the criticisms we made. There is a lot of uncertainty about this parade in view of the statement by the Orange Order welcoming everyone who was there on day one."
