An action by a man who claimed he had part of a leg amputated due to a fall on a footpath in Fairview was settled at the High Court yesterday.

Mr Derek McDermott (39), unemployed, of Killester Avenue, Dublin, had taken proceedings against Dublin Corporation, An Bord Gais, Telecom Eireann and the ESB over the alleged fall at Lower Fairview Avenue on October 24th, 1990.

He claimed he tripped and fell across a manhole cover surrounded by a repaired footpath which had broken and crumbled. He had not been drinking before the accident.

He was driven to his mother's house where he drank almost a bottle of brandy because he was in pain. His leg[ RO] was broken and he had several operations before his right leg was amputated below the knee in 1993. Dublin Corporation, which made the defence for all defendants, denied all the claims.

The defence said that if he had had an accident, it was caused by his own negligence.
