The High Court has refused to grant three Co Donegal farmers injunctions restraining Donegal Creameries from harvesting 200 acres of barley and 15 acres of potatoes on the former Graham farmstead, recently seized by a bank and sold to the creamery.

Mr Gordon and Mr Alfred Elder and Mr Robert McClay had told the court they had taken the land in a conacre agreement with the Graham's and had cropped it.

Mr Justice Hugh Geoghegan said the alleged agreements with the Grahams were made after the bank had obtained an order for possession. In his opinion, as a matter of law the farmers had no prospect of success.
