Mr Garrett Cooney SC, for JMSE, referring to an article in the Sunday Business Post on May 31st, last year, put it to Mr Gogarty: "Isn't it a fact that this is sheer fantasy on your part?"

Mr Gogarty: "Fantasy and frolic? That's your judgment, and I have to leave it to the tribunal to investigate the whole lot."

Mr Cooney asked was it not fantasy born out of the desire to cause further damage to his former employers, against whom he was pursuing a vendetta.

"Not at all," said Mr Gogarty.

Asked if there was no doubt that he entertained a sense of grievance against JMSE, he said: "It was based on their conduct, on their threats and intimidation, their vicious attacks on me, the whole lot. I'm human. I'll go to my grave against that bloody vengeance that is still holding over me. "And what's more, you are telling me that I ripped off the taxpayer with fraudulently getting (Garda) protection. I want to thank the tribunal that directed that I be protected for 24 hours."

Mr Cooney put it to Mr Gogarty that his fantasy grew directly from a sense of grievance and the desire to hurt his former employers.

"I deny it was a fantasy. It's a reality if you face the facts. You have documentation in your own possession to support what I am saying, if you have the guts to allow full disclosure. But you are pre-empting it by every bloody process, technicality and spin-doctoring. I see them over there, but I will fight my corner.

"If there was action taken in 1994 (over the telephone calls), I honestly believe I'd have been spared the last five years and maybe you as well, too, and you wouldn't be here earning the fees you are today."
