A driver for Dublin tour bus has been cleared of responsibility by the High Court today of causing serious injuries to an elderly couple.

Mr Justice Clarke ruled that because the driver, Mr Arthur Ebbs, was unaware he was suffering from an illness which caused to have a complete blackout when driving his bus, he cannot be held responsible for the accident.

The couple, Mr Michael and Ms Kathleen Counihan of Seafield Close, Blackrock, Co Dublin, were injured when they were struck by the bus after it had mounted the pavement near the entrance to Belfield Court Apartments in Dublin.

Mr Justice Clarke said his finding had left the couple in an unfortunate situation where they were deprived of appropriate compensation for injuries sustained through no fault of their own.

However, the judge said that a change in the law was a matter for the Oireachtas.
