Trespass case of autistic boy adjourned
The case of a mildly autistic boy who is unable to give legal instructions to his solicitor has been adjourned pending a decision by the Director of Public Prosecutions on whether the prosecution will be dropped.
The west Dublin boy (12) is facing a charge at the Dublin Children's Court for trespassing at the Cherry Orchard Community Centre, in Ballyfermot in May, when was 11.
A special hearing has been ordered to determine whether he is fit to plead.
His solicitor Catherine Ghent said there had been difficulties in "vindicating his rights to a fair trial as there was an issue over his capacity to give legal instructions".
A consultant psychiatrist is to carry out an assessment of the boy.
Ms Ghent has written to the DPP to ask to have the prosecution withdrawn.
The boy, who has an extremely supportive family, had been showing signs of behavioural problems from an early age. He has been under the supervision of a psychiatrist since he was seven and had been found to have attention deficit hyper-activity disorder and conduct disorders.
Later assessments found that he has Asperger's syndrome, a mild form of autism, and efforts are under way to have a social worker allocated to assist him.
Earlier Ms Ghent had said that if prosecution was not withdrawn, High Court proceedings would be initiated to seek an order for prohibition of the boy's trial on the grounds of his right to a fair trial.
Man in boxers 'was chasing girls'
A man arrested after he was reported to be running around the streets in his boxer shorts "chasing girls" was given a suspended prison sentence yesterday.
Paul Summers (20), Ballyfermot, Dublin, pleaded guilty to assaulting three gardaí and to public order charges following his arrest at Croftwood Crescent last March.
Dublin District Court heard he had assaulted a member of staff in a supermarket as he tried to steal drink. Gardaí were alerted that a man fitting his description was "running around in his boxer shorts chasing girls". When they arrived at Croftwood Crescent, they found him still in his shorts.
He was taken to Ballyfermot Garda station where he kicked and spat at three gardaí as they tried to deal with him.
The court heard he had 35 previous convictions, including 10 for public order offences to which he pleaded guilty in Kilmainham District Court last Monday. He was given a 12-month probation bond.
Judge Hugh O'Donnell imposed a six-month prison sentence, suspended for two years. He told him he was "a very lucky man not to be going to jail".
Four held over pub armed threat
Gardaí in Cork are continuing to question four men after they allegedly walked into a pub carrying shotguns and threatened a customer.
The men were arrested after a high-speed chase.
At least two men walked into the White Horse in Ballincollig at 8.45pm on Monday night, one was armed with a shotgun. They allegedly confronted a man who was drinking in the pub and a row erupted.
Sources say the threat may have been part of a feud between two criminal gangs.
Gardaí in Gurranebraher station are investigating.
