DWAYNE FOSTER remained silent when questioned repeatedly at Coolock Garda station about his whereabouts on March 5th, 2006, the date Donna Cleary was shot, video footage has revealed.
At Dublin City Coroner’s Court yesterday, as part of an inquest into his death, the jury was shown footage of Mr Foster being questioned by Det Sgt Donal Brazil.
The footage, which was about 30 minutes long, shows Mr Foster, who was dressed in a white forensic suit with the hood pulled up, being questioned at Coolock station after being cautioned.
At the outset he informed gardaí that he did not intend to answer any questions, on the advice of his solicitor, before giving his name, address and date of birth. He then asked for a tissue, blew his nose and made no response to any of 40 or so questions posed by Det Sgt Brazil.
The detective told Mr Foster he has been arrested in connection with an incident where shots were fired in a house at Adare Green on March 5th. “As a result of those shots being fired, one woman, Donna Cleary, sustained injuries which proved to be fatal,” he told Mr Foster. “Do you remember any of this, do you, or were you coked out of your brain?” he asked him.
Mr Foster made no response.
In evidence yesterday, Deputy State Pathologist Dr Michael Curtis said there were a large number of injuries on his body at post-mortem, which would have been painful, but would not have contributed to death. His postmortem found that he had died from methadone intoxication. The injuries, which were caused by blunt force trauma, were “minor”, Dr Curtis told the inquest. Some “may have been caused by blows”.
The inquest continues today.
