The High Court has directed all parties involved in the unsuccessful challenge by Sinn Féin TD Pearse Doherty to statements made by the Referendum Commission during the referendum on the fiscal treaty to pay their own legal costs.
Mr Justice Gerard Hogan yesterday ruled the Sinn Féin finance spokesman had raised “serious” and “worthy” issues in his action, which justified the court departing from the normal rule that the winning side got its costs against the losing party.
However, Mr Doherty was not entitled to his costs against the commission on grounds including that he had delayed bringing his challenge, the judge said.
The parties must pay their own costs, he directed.
