The Supreme Court has reserved judgment on an application by opponents of a dump near Kill, Co Kildare, for the matter to be referred to the European Court of Justice. Two years ago residents living near the dump lost a High Court action to prevent the development. They now claim this decision breached European law.

The dump is intended to take five million tonnes of waste from Dublin over a 10-year period. In the High Court it was submitted that the dump would cater for the south Dublin metropolitan region and would be imposed on the residents who had nothing to do with the source or origin of the material.

Yesterday the residents asked the Supreme Court to refer the matter to the European Court of Justice. The Chief Justice, Mr Justice Hamilton, said the five-judge court would give a written judgment.
