An Englishman accused of killing his brother-in-law by running him over with a truck has been acquitted of manslaughter by a jury at Dublin Circuit Criminal Court.

Mr Steven Graysmark (42), with an address at Sundale Avenue, Tallaght, was found not guilty by the jury of the unlawful killing of James Malone of Foxborough Villas, Lucan on August 29th, 1999.

The jury, which deliberated for a total of over five hours over two days, earlier found him guilty of drunk driving on the same occasion.

They disagreed on a third charge of dangerous driving causing the death of Mr Malone, a 31-year-old father of three.

Mr Graysmark had pleaded not guilty to the three charges.

Mr Justice Smyth set the sentence date for the drunk driving charge for October 5th next and remanded him on continuing bail to appear at Dublin Circuit Criminal Court on July 20th next when the dangerous driving causing death charge will be mentioned.
