A MAN has been convicted by a jury of the buggery of a teenage milkman in a Dublin city centre flat two years ago.
Denis Timmons (46), of Thomas Court, was found guilty of the rape of the youth under section 4 of the Criminal Law (Rape) (Amendment) Act 1990 on March 10th. 1994. The jury took two hours to reach its unanimous verdict on the fourth day of the trial.
Timmons has been remanded in custody by Mr Justice Shanley for sentence on November 22nd. Victim impact, probation and psychiatric reports will be prepared for that hearing.
The jury of three women and nine men heard the victim explain that he and an elderly friend were joined by Timmons in a pub. The youth said he drank up to nine pints of Guinness and Timmons offered them a lift home.
After he dropped off the older man, Timmons said he was expecting an urgent telephone call in his flat and drove there. The victim said he wasn't feeling well and accepted an invitation from Timmons to lie down.
Timmons raped him on the bed. While he screamed Timmons said: "I like breaking you in", the victim told prosecuting counsel, Mr Joseph Mathews SC (with Mr Conor Devally).
The jury also heard the youth had to be held down by his brother and mother when he got home in a hysterical state and related what happened to him.
He told his mother to remove his confirmation photograph from the wall because he was not her son any more. She told the jury she had a feeling that night that something was wrong because he had not arrived home at 9 p.m. as usual.
Garda Patrick Normile said he got Timmons's address from a computer search: "As luck would have it his car had been impounded the previous day and details were on the system."
Garda Normile said he and a colleague, Garda Bernard Jones, had to trick the accused man into opening his flat door when they called and got no reply. He arranged for Garda Jones to go back down the stairs making plenty of noise and to hang the outside door as if they were leaving. Timmons then emerged and was arrested.
