A Galway man has been remanded on bail after his sentencing for the statutory rape of his teenage sister-in-law was adjourned pending the outcome of a Supreme Court hearing.
The man (33), who cannot be named, was found guilty last November at the Central Criminal Court of the unlawful carnal knowledge of the girl when she was aged just 15. The jury cleared him of rape.
The Supreme Court will tomorrow hear an appeal brought by the State over the release of the 41-year-old man, known as Mr A, who was convicted of the unlawful carnal knowledge of a 12-year-old girl.
He was freed on Tuesday by the High Court after Ms Justice Mary Laffoy ruled that his detention was unlawful after the law he was convicted under was deemed unconstitutional.
Mr Justice Iarfhlaith O'Neill told the Central Criminal Court today that Galway man's sentencing should be adjourned until next term.
"It would seem to me that the justice of the situation requires that the outcome of the appeal of the 'A' case be awaited. So I'm going to adjourn sentencing in the hearing for a sufficient length of time until after the Supreme Court hearing."
The sentencing will be heard on June 27th.
