A KILKENNY-BASED man who claims he is mentally damaged from military service in Algeria was in court yesterday for threatening to decapitate his ex-girlfriend.
Bachir Midoun (40) faces up to five years in prison for the threats but Judge Desmond Hogan said he intended to impose a two-year sentence suspended in full, provided Midoun carries out 240 hours’ community service and seeks treatment for his alcoholism.
He remanded Midoun on continuing bail until April while a report is prepared on his suitability for community service.
Midoun, of Lintown Green, Kilkenny, pleaded guilty at Dublin Circuit Criminal Court to leaving a threatening voicemail for the woman on July 29th, 2009.
Sgt Liam Cummins told the court that Midoun began a relationship with her in 1998 and they had a child. The relationship broke down. The woman got a barring order against Midoun in 2002. In July 2009 she complained to gardaí about text messages she had received from him.
One read: “Ballymun scumbag bitch, make sure you call me in 24 h, baldy bitch.” The next day she again went to gardaí saying she had received a voicemail from Midoun. It stated: “I will kill you softly, first by taking your head, then by taking your teeth out, then by taking your blood.”
“I note how quickly he has become acquainted with the finer nuances for the English language,” Judge Hogan commented.
Midoun was arrested and made full admissions, saying he was drunk when he sent the messages. He said the woman had cut off access to his daughter and this had affected him greatly. Judge Hogan said if he was being denied access to his child “there were other paths open to him” to address this.
