Morris Tribunal: The Morris tribunal has been asked to seek statements taken by four detectives from the National Bureau of Criminal Investigation (NBCI) in order to show "a pattern of framing up".

The four gardaí interviewed Mr Frank McBrearty jnr when he was arrested on December 4th, 1996, during the investigation into the death of Raphoe cattle dealer Mr Richie Barron.

Mr McBrearty has denied making any statement while being interviewed by the detectives.

Mr McBrearty asked that all statements taken by four members of the NBCI "since they entered the Garda force" be handed over to him.

He also asked for statements taken during the "Kerry Babies" case.

"I wish to have all statements taken by [ Insp] Gerard McGrath, [ Sgt] Éamon O'Grady, [ Sgt] John Melody, and Det Garda John Fitzpatrick," he told the tribunal chairman.

"I can show to this tribunal a pattern of framing up, which they did to me," Mr McBrearty said. "I'm asking the State to hand them over to me."

He added: "That is what this tribunal is about, chairman, a public inquiry into why a false confession was created against me, and I am entitled to show a pattern, the way these Garda officers conduct their business."

Mr Justice Morris said he would consult the tribunal legal team before seeing if there was "an advantage" in following Mr McBrearty's suggestion.

Mr Brian Murphy, representing Garda John O'Dowd, later told Supt Joseph Shelly he was changing his evidence as he went along. Mr Murphy also said the superintendent had given conflicting accounts in statements of where he was the day Mr McBrearty jnr was arrested.

"You give your answers depending on what you think is the right thing to say," said Mr Murphy.

Supt Shelly denied this.
