Judge Liam Devally, in the Circuit Civil Court, yesterday, said two Dublin men, Mr George Carthy and Mr Martin Gunnery, were "drunk to the gills" when they attacked a teenage waiter after he told them they faced a £4 minimum charge in his mother's restaurant in Parkgate Street, Dublin.

The judge said Mr Carthy and Mr Gunnery had caused a boiler of scalding water to be turned over in Park's Restaurant, which had spilled on Mr Carthy's wife, Catherine, of Greenfort Lawns, Quarry vale, Dublin, injuring her right foot.

He dismissed Mrs Carthy's claim against the restaurant for £30,000 damages for personal injuries and awarded costs against her.
