A publican had a summons for breach of the opening hours struck out yesterday when the judge heard that four people found on the premises were attending a local TD's constituency clinic at the time.

Mr James Noone of Mountbellew, Co Galway, was prosecuted for having his public house open at 9.35 a.m. on September 28th.

When Judge James O'Sullivan was told that the people on the premises had been attending a clinic held by Mr Paul Connaughton TD, he struck out the summons when £40 was paid into the court poor box. He also struck out summonses against those found on the premises.
