The High Court yesterday reserved judgment on an action taken by a child alleged to have cerebral palsy and severe mental handicap as the result of the circumstances of his birth at Wexford General Hospital.

Gerard Doyle, now aged five, had sued, through his mother, Vera, of Clongeen, Foulksmills, Co Wexford, the South Eastern Health Board, and Dr Nasim Osmani Subhi for alleged negligence in the course of his delivery at the hospital in November 1992. Dr Subhi was employed as obstetric registrar at that time.

Shortly after the hearing opened on January 28th last, Mr Justice Smyth approved a settlement under which Gerard, who has been grossly disabled since birth, and his parents, are to be paid £1,125,000. The case continued to deal only with the question of liability. Both defendants deny negligence.
