SENTENCE on a man who buggered a teenager two years ago was postponed because he was not satisfied with his psychiatric report.
Denis Timmons (46), of Thomas Court, Dublin 8, was found guilty on October 10th last by a jury at the Central Criminal Court of raping the teenage milkman in his flat. He was remanded in custody for sentence.
The jury convicted him of rape of the youth under Section 4 of the Criminal Law (Rape) (Amendment) Act 1990 on March 10th, 1994. The unanimous verdict came after two hours deliberations on the fourth day of the trial.
When the case came back before Mr Justice Shanley for sentence, Mr Barry White SC, defending, said he had to ask for an adjournment.
He said his client was not happy with the meeting he had with a consultant psychiatrist and now wanted to speak to a different psychiatrist. The first psychiatrist's report was before the court and Mr White said he would like a further opportunity to discuss the matter with Timmons.
Mr Joseph Mathews SC (with Mr Conor Devalley), prosecuting, said he could not object to the request in the circumstances.
Mr Justice Shanley agreed to adjourn the sentence and reentered the case for mention next Wednesday.
The jury heard the victim describe how he was taken by Timmons to his flat after the defendant offered him a lift home following a meeting in a pub with an older, mutual friend.
Timmons first dropped off the older man and then said he was expecting an urgent telephone call in his flat. The victim said he was not feeling well and accepted an invitation from Timmons to lie down.
Timmons raped him on the bed.
The jury also heard the youth had to be held down by his brother and mother when he got home in a hysterical state and related what happened to him.
