The sentencing of a convicted rapist, allegedly hired by a woman's estranged husband to break into her home and attack her, has been put back to February 21st, 2005 to allow a psychiatric report to be complied.

Martin Dunne (46), of Collins Drive, Finglas, was found guilty of raping and falsely imprisoning the woman in her west Dublin home by a jury in the Central Criminal Court on November 2nd, 2004.

He had pleaded not guilty to committing the offences in the early morning of August 24th, 2001.

Dunne discharged his legal team on day eight of the 11-day trial, conducting his own defence thereafter.

Mr Niall Durnin (with Miss Caroline Biggs), defending, applied for the adjournment telling Mr Justice Herbert that he had received papers in relation to the case two weeks ago.

He said that a psychiatric report on Dunne was needed due to factors in his background and the circumstances of his life in recent years.

On the day of the verdict Dunne declined the preparation of a probation and welfare service report saying he has "no faith in the probation services".

Mr Justice Herbert said he had sympathy for the bitter disappointment the victim would feel at the adjournment but added, "it is the overriding duty of the court to ensure justice is done".
