Two directors of Squash (Ireland) Ltd, in liquidation, did not act responsibly in their conduct of some of the company's affairs, the High Court found yesterday.
The President of the High Court, Mr Justice Morris, made an order under Section 150 of the Companies Act against the two directors, Mr David Balbirnie, Lower Pembroke Street, Dublin, and Mr Trevor Watkins, Clonard Road, Dundrum, Dublin.
Such an order restricts a person found in breach from acting as a director of another company for five years unless they meet conditions stipulated in the legislation.
The judge put a stay on his order to allow an appeal to be taken to the Supreme Court. The action hinged on the solicitation and acceptance of fees from club members just prior to the collapse of Squash (Ireland), which the judge decided was not responsible conduct.
