Examiner petition fails

A PETITION to appoint an examiner to a printing company was struck out in the High Court yesterday

A PETITION to appoint an examiner to a printing company was struck out in the High Court yesterday. A former director of the company had challenged the validity of the petition.

The judge said, in his view, a board meeting of Aston Colour Print Ltd, St Stephen's Green, Dublin on January 27th last could not be regarded as a board meeting. He did not accept there was any resolution, formal or informal, passed at the meeting to seek the appointment of an examiner. The judge ordered the petition to be struck out because it was improperly presented and that the interim examiner be discharged.
