An application by the Controller of Patents, Designs and Trade Marks for injunctions against the Minister for Enterprise, Trade and Employment and the Government was refused by the High Court yesterday.
Mr Justice Kelly, however, made directions in relation to the proceedings with a view to having an early trial of the action. It is hoped to have the trial in the next law term in October.
The Controller, Mr Sean Fitzpatrick, secured High Court permission last January to bring judicial review proceedings and to apply for an order to prohibit any attempt to remove him from office before the year 2008.
