THE liquidator of the Taylor Group will apply to the High Court on Monday for permission to continue the process of pursuing Mr Tony Taylor and his wife Shirley for the debts of the companies.
In a separate hearing, the High Court will also hear an application by counsel for Mrs Shirley Taylor regarding what should be done with the contents of the couple's home. These are currently in storage, following the sale of their luxurious house in Ballsbridge, which made £580,000 last month.
The liquidator, Mr Paddy McSwiney of BDO Simpson Xavier, will ask the court for permission to serve proceedings on the Taylors under Section 204 of the Companies Act. This section deals with the liabilities of officers of the company where proper books and accounts have not been kept.
The liquidator can seek to make the directors personally liable for the debts. If they are found liable, the liquidator can go after any assets they may have. Monies from the sale of the house, minus £120,000 which was owed to National Irish Bank (NIB), were ordered to be paid into court in December. Mrs Taylor is to pursue her claim for half of these monies.
It is understood that counsel for Mrs Taylor, who is said to be out of the jurisdiction, will accept notice of proceedings by the liquidator. However, it is unclear how notice of such proceedings can be served on Mr Taylor.
The Taylors left the country last August. Clients are owed £2.5 million.
It is understood that the gardai have a fair idea of Mr Taylor's current whereabouts, but have not formally interviewed him to date.
