AN undertaking was given in the High Court yesterday by West Limerick Resources that it would not hold elections or take any steps towards appointing a director in place of a man who brought injunction proceedings against the company.
The man, Mr Patrick O'Doherty Turrett Street, Ballingarry, Co Limerick, gave an undertaking not to attend any meeting of the board. Both undertakings are until further court order.
West Limerick Resources, registered in August 1993, was incorporated to promote and co ordinate resources in the area with a view to generating enterprise and creating employment.
Mr O'Doherty, in an affidavit said he was voted in as a director of the company at its a.g.m. last November. He was the only candidate nominated by the Community Committee groups of the Rathkeale area.
In January, the company stated it was advised by counsel that the election results were prima facie void due to inadequacies in holding the November meeting. The company later issued notice of a further a.g.m. to be held last night. Mr O'Doherty sought to prevent this meeting going ahead.
He was advised by counsel that the November elections remained valid and that he was a validly elected member of the board.
Mr Sean Liston chairman of the company, in an affidavit, said that at a board meeting on January 3rd last legal advice ,received by the company was considered.
This was to the effect that the Rathkeale district election was prima facie void, due to inadequacy of notice given to some groups. It was resolved the election should be re held.
