Mr Brady, who commenced personal injuries proceedings through his wife Roseanne prior to his death, sued the Motor Insurers Bureau of Ireland, the Minister for Transport, the Minister for the Environment and Local Government, Ireland and the Attorney General.

Proceedings were brought against the MIBI, who have undertaken to compensate the victims of road traffic incidents involving uninsured drivers, because it was claimed that Mr Finnerty was not insured to carry Mr Brady in the rear of his car.
