ACC BANK has secured summary judgment for more than €2.6 million against a brother and sister over an unpaid loan related to a property development in Co Waterford.
In opposing summary judgment, Pat Flynn, Killea, Dunmore East, Co Waterford, and his sister Helen McGardle, Booterstown Avenue, Blackrock, Co Dublin, had argued representations had been made on behalf of the bank the money would not be repayable until the development, at Killea, Dunmore East, Co Waterford, was complete. The bank denied it had made such representations.
At the Commercial Court yesterday, Mr Justice Brian McGovern ruled that ACC was entitled to summary judgment of €2,674,729 plus interest against the defendants after finding that they had not made out an arguable defence to the bank’s claim.
The bank had advanced the pair €3.6 million in October 2007.
