An accused man was in bed at the time he is alleged to have been driving a stolen car, the man's father has said. The car was in a collision which caused the death of a father and daughter.

Mr Alan Martin was giving evidence at Dublin Circuit Criminal Court. Mr Martin told Ms Iseult O'Malley, defending, that he had slept on a settee in the living room all night, facing the bedroom in which the accused slept. His son had not left the flat that night. It was day eight of the trial.

Mr Declan Martin (28), Pearse Street, Dublin, is pleading not guilty to two counts of dangerous driving causing death, one count of dangerous driving causing serious harm to another person, unlawful use of a vehicle and driving without insurance on September 20th, 1999.
