An application by two men for an order restraining DúLaoghaire-Rathdown County Council from removing 10 metres of an ancient walled ditch from the route of Dublin's South-Eastern Motorway at Carrickmines is to be heard by the High Court tomorrow.
Mr Dominic Dunne, Collins Square, Dublin, and Mr Gordon Lucas, Willbrook Lawn, Rathfarnham, Dublin, secured leave last week to notify the council of their intended application for an injunction against it.
When the case came before Mr Justice Lavan yesterday, he was told that lawyers for the two applicants had given affidavits to the council, and the latter needed time to reply to them.
Mr Dermot Flanagan SC, for the council, said that the matter was of great urgency and he asked the court to take that into account. Mr Frank Callanan SC, for the applicants, suggested that a date be allocated this week to hear the application.
Mr Justice Lavan said that he would hear the case tomorrow.
The application by Mr Dunne and Mr Lucas is separate from proceedings in which the council was granted an interlocutory injunction last week restraining anyone with notice of the order from trespassing on council land at Carrickmines Castle, which is included in lands acquired for the motorway.
