IN A court report published in the editions of January 18th 1997, it was implied that Mr Brendan Counihan, Senior Assistant Solicitor in the Chief State Solicitor's Office, in giving evidence to the High Court, indicated that it was mentioned to him on October 29th, 1996, that Judge Dominic Lynch had been delisted as a member of the Special Criminal Court and that consequently Mr Counihan had tailed to take action in this regard until November 5th, 1996. The Irish Times accepts that Mr Counihan only became aware of a problem regarding Judge Lynch's status on November 5th, 1996, and acted thereon immediately. Accordingly, The Irish Times apologises unreservedly to Mr Counihan for any embarrassment caused to him by the report and has, at Mr Counihan's request, made a donation to charity.
