A Co Wicklow woman described by a judge as having an inability to cope with pain has been awarded £7,500 damages in the Circuit Civil Court. However, the judge said the woman had not co-operated fully with her medical advisers in her recovery.
Ms Noeleen Ellis (28), of Seaview Heights, Rathnew, was injured when a bus struck a pillar in the grounds of Beaumont Hospital five years ago. She was still complaining of pain and discomfort, her counsel said.
Judge Carroll said exercises were a key element in the treatment of soft tissue injuries and frequently involved tolerating a good deal of pain and discomfort.
"I don't think a plaintiff is entitled to lie down and abandon advice given to assist recovery and then expect the defendants to pay for that," he said.
