Bail conditions lifted for holiday

A MAN accused of threatening a Dublin publican to stop trading “within 24 hours” has had his bail conditions lifted temporarily to allow him go on a three-week holiday to Australia.

Derek Nolan (29), Seacliff Road, Baldoyle, Dublin, had been charged on May 13th last at Dublin District Court under section 17 of the Public Order Act with making a demand with menaces, on March 13th last, to Shane Simpson, the former leaseholder of the Castle public house in the inner city.

The charge also states that this was to “gain for yourself or another” or “to cause loss to another made an unwarranted demand, to cease trading in the Castle public house and close within 24 hours”.

John Stokes (54), a Dublin publican, with an address at the Players Lounge in Fairview, and two other men have also been charged with the same alleged offence. They and Mr Nolan had been remanded on bail to appear again next month and bail conditions were imposed.

Yesterday at Dublin District Court, Mr Nolan sought to have his bail conditions suspended. He had been ordered earlier to stay away from Shane Simpson as well as his brother Stephen Simpson “and staff from the Castle pub”; not to associate with his co-defendants, not to go to the Dublin 1 and 3 areas and to sign on daily at his local Garda station.

His solicitor, Michael Finucane, told Judge David McHugh that his client had booked a family holiday to Australia before he was charged.

He asked the court to lift the bail conditions during the trip, from May 25th to June 17th. The judge agreed to do so.
