An attempt by Ian Bailey to have his appeal against his extradition to France reheard by the High Court will be considered by the Supreme Court next month.
The application was due to be heard today, but lawyers for the State yesterday told the Chief Justice, Mrs Justice Susan Denham, they were not ready for the hearing.
Mrs Justice Denham told lawyers for both sides all papers for the application must be lodged as soon as possible, and adjourned the hearing to January 13th next.
Unless his application is granted, Mr Bailey’s Supreme Court appeal is scheduled to begin on January 16th.
A former journalist, Mr Bailey is wanted for questioning by an investigating judge in France in connection with the death of Sophie Toscan du Plantier.
The body of the 39-year-old French film-maker was discovered near her holiday home in Schull, Co Cork, on December 23rd, 1996.
Mr Bailey has always denied any involvement in the murder. He was arrested by investigating gardaí and the Director of Public Prosecutions found no basis on which to charge him.
