The High Court has continued an order restraining an internal Garda inquiry into allegations of breaches of discipline against Co Donegal-based gardaí from proceeding.

The inquiry was due to begin on May 1st.

On Monday last, it was argued on behalf of Garda Patrick Mulligan and Garda John O'Dowd, formerly of Raphoe station, that the internal inquiry should not go ahead pending the outcome of a tribunal established by the Dáil into Garda activities in Co Donegal.

The gardaí secured leave to seek an order, by way of judicial review, preventing the internal inquiry proceeding until the tribunal concludes its business.

Yesterday, Mr Eamon Leahy SC, for the Garda authorities, said they were not consenting to adjourn the disciplinary matters pending the outcome of the tribunal.

Mr John Whelan SC, for the two gardaí, asked that the order preventing the internal inquiry proceeding pending the outcome of the tribunal be continued.

Mr Justice McKechnie said he would continue that order until further court order or until the judicial review proceedings were determined. He adjourned the case for mention to May 8th next.
