A 79-year-old man was among five Terenure, Dublin, bin-tax protesters who escaped fines or imprisonment yesterday when they gave sworn undertakings to the High Court to comply with injunctions restraining them from interfering with Dublin City Council bin collections.

Mr Joseph O'Brien (79), of Mount Tallant Avenue, Terenure, said he should not be before the court because he had not stopped any vehicle from collecting waste. After giving an undertaking to comply with High Court orders, he complained that his applications for waiving bin collection charges had not been dealt with. He was assured by Ms Carol O'Farrell, counsel for the local authority, that the matter would be further looked into.

The others who gave undertakings were Mr Philip Thomas and Ms Yvonne Thomas and Mr Daniel O'Donovan, all of Mount Tallant Avenue, and Ms Eileen Murphy, Melvin Road, Terenure.

A motion to commit Ms Karen Heffernan, School Street, Dublin, and Ms Bríd Smith, O'Hogan Road, Ballyfermot, Dublin, for alleged contempt of court was adjourned until October 13th.
