Bread company Brennans is appealing to the Supreme Court against a finding that it is not entitled to sell its wholewheat bread in packaging found to be “confusingly similar” to that of a brown bread product of rival company McCambridge.

Mr Justice Michael Peart yesterday agreed to put a one-week stay on his order restraining Joseph Brennan Bakeries, trading as Brennans, from selling the bread in the disputed packaging.

The stay was granted to facilitate the bringing of an appeal by Brennans against the judge’s finding last week that the packaging used in the Brennans product was likely to cause confusion among consumers. McCambridge Ltd brought proceedings against Brennans earlier this year.
