The Criminal Assets Bureau is seeking judgment for almost £3 million against a Dublin man, Mr Matthew Kelly, in respect of alleged unpaid tax and interest.

The application by the CAB was listed for hearing yesterday but was adjourned on the application of Mr Shane Murphy, for the bureau. Counsel said he had just received detailed affidavits on behalf of Mr Kelly and required a short adjournment to file a replying affidavit.

Mr Murphy told Mr Justice O'Higgins that CAB would be seeking summary judgment against Mr Kelly, of Ashington Gardens, Dublin, in the sum of £2,950,866.

Counsel said a tax agent for Mr Kelly had stated the sum due was £628,000 and he asked the judge to enter summary judgment in that figure pending the full hearing. There was a "clear and unambiguous" statement that amount was due and owing, Mr Murphy said.

Dr Michael Forde SC, for Mr Kelly, said he would be disputing the claim that there was an unequivocal concession that a sum of £628,000 was owing.

Counsel said he had instructions from his client to give an undertaking that Mr Kelly would not reduce his assets below that figure pending the full hearing. That undertaking would give CAB full security, Dr Forde said.

The matter was then adjourned to February 23rd.
