Former minister of state Ivor Callely is believed to have sought advice recently to ascertain whether he is obliged to list properties owned by his wife, or one owned jointly by him and his wife, in the Dáil's Register of Members' Interests.
It was reported before Christmas that Mr Callely had a half-share in a house in Artane with his wife, Jennifer.
Ms Callely also owns a number of other properties. Under ethics legislation, TDs and senators are required to declare their financial interests, including property and shares.
Ministers and Ministers of State must make a further, private declaration to the Clerk of the Dáil of any financial interest belonging to a spouse or children "which could materially influence you in, or in relation to, the performance of the function of your office".
Mr Callely is understood to have sought advice as to whether he should declare the house jointly owned with his wife, or his wife's own properties.
All TDs and senators were required to make their annual declaration by last Tuesday, January 31st. This declaration covers the year 2005, in which Mr Callely was a minister of state.
A spokesman for the Standards in Public Office Commission confirmed that Mr Callely had made a declaration by the deadline, but would not comment further.
