Case against hospital is settled for ?2.25m

A Co Tipperary man who took legal proceedings alleging negligence in his treatment at St Joseph's Hospital, Nenagh, Co Tipperary, following a motorcycle accident, has settled his High Court case for €2.25 million.

The action was taken by Mr Jonathan Tully (28), Main Street, Ballyporeen, against the Mid-Western Health Board, proprietor of St Joseph's Hospital, Nenagh; Dr Sohail Shahzad, a doctor at the hospital; and Dr David McAvinchey, a consultant surgeon there.

When the case came before Mr Justice de Valera yesterday, he was told by Mr Jim O'Driscoll SC and Dr John O'Mahony SC, for Mr Tully, that the action had been settled for €2.25 million.

It was claimed that on the night of August 23rd, 1997, Mr Tully was involved in a motor-cycle accident as a result of which he received severe injuries and was rendered unconscious.

He was admitted to St Joseph's General Hospital at 11.45 p.m. before being sent to Limerick General Hospital. The action was taken following Mr Tully's treatment at the Nenagh hospital. The settlement was made without admission of liability.
