The case against Judge Brian Curtin of the Circuit Court alleging possession of child pornography was adjourned by consent yesterday at the Circuit Court in Tralee.
It was the first time the case has come before the Circuit Court, although it has been before the District Court on several occasions.
Ms Catherine Irvine from the Chief State Prosecutor's Office said she and Mr Robert Pierse, solicitor for Judge Curtin, were making a joint application for an adjournment.
The defence was seeking to inspect a number of exhibits in the case and the State was making these available for examination.
Judge Curtin (51) is charged with knowingly possessing child pornography under the Child Trafficking and Pornography Act 1998 at Ard na Li, Tralee, on May 27th, 2002.
At a previous adjourned hearing of the case in the Tralee District Court in April, a large folder of images allegedly downloaded from the Internet onto Judge Curtin's computer was handed into court. However, Mr Pierse argued at a further hearing in June he had not been given an opportunity to see the images handed in, nor had his client.
"Our appearance at this stage is not accepting the validity of any act done so far. I am making this point because I was unable to make it at a preliminary examination in the District Court." He said he was formally reserving his position.
Judge Carroll Moran granted the adjournment until November 11th at the Tralee Circuit Court.
