Dunnes Stores has undertaken before the High Court, pending the outcome of legal proceedings, not to sell garments bearing the name Champion in its stores.
Mr Justice Kelly was shown a range of garments which are on sale in Dunnes and about which Champion Sports had made complaints. The judge commented that his garment-laden bench was "beginning to look like the Daisy market".
On being given the undertaking that Dunnes will not sell any more clothing items bearing the word Champion pending the outcome of a full hearing, the judge fixed October 21st for the trial of the action.
In an affidavit, Champion's financial controller, Mr Jonathan Lyons, said the company's brand name was recognised in many countries throughout the world as being a premium brand of high-quality clothing and sports apparel, footwear and accessories.
On April 12th, 2003, the company's managing director Mr Bernard Millen discovered that the defendant was selling items of children's clothing bearing the word Champion.
The garments being sold by the defendant were retailing at a fraction of the price at which the plaintiff's products were sold.
